TERMS OF SERVICE

Terms of Service.

These terms govern your use of FundedPilot and every evaluation you purchase. Please read them together with our Trading Rules.

1. Who we are

FundedPilot (thefundedpilot.com) is operated by Georg Steinbauer, Erlenweg 46, 8530 Deutschlandsberg, Austria (“FundedPilot”, “we”, “us”). Contact: support@thefundedpilot.com. Full details are in our Imprint.

2. What we offer

FundedPilot offers simulated trading evaluations. You trade a demo account with simulated funds under defined rules. No orders reach a real market, no real capital is traded and you never receive or manage real funds. FundedPilot is not a broker, does not accept deposits and does not provide investment, financial or tax advice.

If you meet the evaluation objectives, you may be offered a simulated performance account. Performance rewards (“payouts”) are paid by FundedPilot according to the Trading Rules. They are not returns from real trading.

3. Eligibility

  • You must be at least 18 years old and legally able to enter into a contract.
  • You must be a private individual acting for yourself, not a professional trader, and you confirm this before every purchase.
  • You may not use trading bots or any automated trading.
  • You may hold at most 2 open accounts at the same time.
  • You may not be a resident of, and may not trade from, any restricted country: the United States of America, Russia, Belarus, Iran, North Korea, Syria, Cuba and the Russian-occupied regions of Ukraine (Crimea, Sevastopol, Donetsk, Luhansk, and the occupied parts of Zaporizhzhia and Kherson). This applies to your place of residence, not your citizenship. You confirm this when you sign up and before every purchase.
  • You may only use the service where it is lawful in your country of residence.
  • You must provide true and complete information and keep it up to date.
  • We may refuse or end the service for persons from countries we cannot serve, or where sanctions or legal requirements apply.

If we find that you are a resident of a restricted country, trade from one, or gave false information about your residence, we close all your accounts and no payouts are made. We may check your residence at any time, in particular during identity verification (KYC), and use technical measures such as IP-based blocking.

Market data status. When you first log in to the trading platform, you must declare yourself a non-professional market data user. Professional market data costs us many times more. If you declare yourself professional, you breach these terms. We may then close all your accounts immediately and permanently, without refund, and no payouts are made for these accounts. You must also reimburse us for the additional market data fees this causes. These are the fees the exchanges charge for professional users, currently up to about USD 137.50 per exchange and month instead of about USD 10 in total, and they are usually charged for the full calendar month. We will send you an invoice listing these fees, and it is due within 14 days. If it remains unpaid, we may claim it through legal means, including reasonable collection costs.

4. Your account

You need a FundedPilot account to use the dashboard. Keep your login and your trading credentials confidential; you are responsible for all activity on your accounts. Each account belongs to one natural person and may not be shared, sold or traded by anyone else.

5. Fees and payment

The evaluation fee is a one-time payment for a simulated evaluation with a term of 30 days from activation of your account. There is no subscription. Prices are shown before checkout. After passing an evaluation, the performance account is activated with a one-time activation fee of $169, payable within 7 days; otherwise the passed evaluation is closed. Payment is processed by our checkout provider; we do not store your card details. The fee is not a deposit, is not traded and is not returned when an evaluation ends.

6. Right of withdrawal (EU consumers)

If you are a consumer in the EU, you generally have a 14-day right of withdrawal. Because the evaluation is a digital service that starts at your request, you agree at checkout that we begin immediately, and you acknowledge that your right of withdrawal ends once the service has been fully performed, which is the case when you place your first trade. Before your first trade you can withdraw by emailing support@thefundedpilot.com, and we refund the fee.

7. Rules and evaluation

All evaluations and performance accounts are subject to the Trading Rules, which form part of these terms. We monitor accounts automatically and manually. If a rule is breached, the consequences described in the Trading Rules apply, up to closing the account without refund.

8. Payouts and verification

Before your first payout you must pass identity verification (KYC). We may request additional documents. Payouts are only made under the conditions in the Trading Rules and after a review of the payout period. We may withhold a payout while a review for a suspected rule breach, fraud or legal requirement is ongoing.

9. Prohibited conduct

  • Breaking the Trading Rules, including prohibited strategies listed there.
  • Exploiting errors, delays or weaknesses of the platform or data feeds.
  • Using false identities, multiple identities or another person's account.
  • Attempting to access data or systems you are not authorised to access.
  • Chargebacks for fees that were charged correctly.

If you initiate a chargeback for a correctly charged fee, we may close all your accounts. No payouts are made for closed accounts. We may submit your order, your consent to these terms and your trading history to the payment provider as evidence. If you already received a payout from an account whose fee you charged back, you must repay that payout, and we may claim it through legal means.

10. Platform and data errors

The trading platform and price data are provided by third parties. If a trade or result is based on an obvious error of the platform, the price feed or our systems, we may correct or remove it. Profits from such errors are not eligible for payouts. Losses caused solely by such errors are not counted against you.

11. Taxes and relationship

You are solely responsible for declaring and paying any taxes on rewards you receive. Taking part does not create an employment, agency, partnership or investment relationship between you and FundedPilot. You do not trade on behalf of FundedPilot and may not present yourself as a FundedPilot trader or representative.

12. Intellectual property

The FundedPilot name, logo, website, texts and software belong to us. You may use them only for taking part in the service. Copying, scraping or reselling any part of the service is not allowed.

13. Ending the contract

You may close your account at any time. We may suspend or close accounts that breach these terms or the Trading Rules, or where required by law. Evaluations end automatically when a hard rule is breached.

14. Liability

We provide the service with reasonable care but cannot guarantee uninterrupted availability of the website, the trading platform or market data. Our liability for slight negligence is excluded, except for injury to life, body or health and where mandatory law provides otherwise. In any case our liability is limited to the fees you paid for the affected evaluation.

15. Changes

We may update these terms for new purchases. Running evaluations and performance accounts keep the terms and Trading Rules that applied when they were purchased, unless you agree to a change. We inform you by email about any proposed change.

16. Complaints

If you have a complaint, email support@thefundedpilot.com with your account details and a short description. We reply within 14 days. We do not take part in dispute resolution proceedings before a consumer arbitration body unless the law requires it.

17. Governing law and final provisions

The law of Austria applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of your country of residence remain unaffected.

If any provision of these terms is invalid, the remaining provisions remain in effect. The Trading Rules and the Risk Disclosure form part of these terms.
